Title IX doesn't apply to private businesses, only public schools and universities that receive money from the government.
NBA owners probably look at the WNBA as a "loss leader" - that is, a marketing ploy designed to promote goodwill, and get more people interested in the sport. With the number of owners that have NBA and WNBA teams, $10 million(between all of them) is nothing when your other investment makes money hand over fist.
And, of course, it would be a PR disaster to pull the plug on this league. Strangely enough, most WNBA stars make way more money overseas playing from October through May.
